1. Introduction
Welcome to Amador, operated by Amador Pty Ltd ACN 692 891 277 ('Amador', 'we', 'us', or 'our'). Amador is a brand rewards network and customer collaboration platform that helps brands collect authentic user-generated content (UGC), build customer communities, run campaigns, and reward ambassador participation.
These Terms & Conditions ('Terms') govern your access to and use of the Amador website, platform, and all associated services (collectively, the 'Services'). By registering for an account, subscribing to a plan, participating as an ambassador, or otherwise accessing the Services, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.
If you do not agree, you must immediately discontinue use of the Services. We may amend these Terms at any time. Updates will be posted at amador.life/terms with the revised date. Your continued use of the Services after any update constitutes acceptance of the revised Terms.

3. Eligibility & Registration
3.1 Age Requirement
You must be at least 18 years of age to register for or use the Services.
3.2 Account Accuracy
You must provide accurate, current, and complete information when creating an account. Amador is not liable for issues arising from inaccurate information you provide.
3.3 Account Security
You are solely responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately at hello@amador.app if you become aware of any unauthorised access.
3.4 One Account Per User
Each person or business entity may hold one account. Creating multiple accounts may result in suspension without notice.
3.5 Account Suspension & Termination
We reserve the right to suspend, restrict, or terminate any account at any time if we reasonably believe these Terms have been breached, or if fraudulent, harmful, or abusive activity is detected.
4. The Platform & Services
Amador provides a brand rewards network where brands and ambassadors can connect, collaborate, and exchange value. The platform enables brands to create and publish campaigns, build community pages, set reward offers, make direct offers to ambassadors, and access AI-assisted campaign tools.
Ambassadors can join campaigns, submit content and reviews, earn Amador Points for qualifying actions, redeem points for brand reward offers, and receive and respond to direct offers from brands.
Amador is a technology platform only. We do not act as agent, employer, staffing agency, or intermediary party to any brand-ambassador relationship or content agreement.
5. Additional Terms for Brands
5.1 Authority to Bind
If you register on behalf of a business or organisation, you represent that you have the legal authority to bind that entity to these Terms.
5.2 Campaign Responsibility
Brands are solely responsible for the content, accuracy, and legality of any campaign they create. You must ensure all campaigns comply with applicable Australian laws, including the Australian Consumer Law (ACL), ACCC guidelines on endorsements and testimonials, and any relevant advertising standards.
5.3 Reward Offers
When you create a reward offer on Amador, you agree to honour all reward offers you publish, ensure all offers are accurately described, fulfil redemptions promptly, and not withdraw or alter reward offers in a way that is misleading or prejudicial to ambassadors.
5.4 Direct Offers to Ambassadors
Brands may make direct offers to ambassadors for specific content or services. All direct offers are subject to mutual acceptance by the ambassador. Amador is not party to any direct offer arrangement.
5.5 Content Ownership & IP Assignment
Upon an ambassador submitting content via a campaign you have created, and subject to any applicable reward or direct offer arrangement being honoured, the ambassador assigns to the brand all intellectual property rights in and to the content, including copyright, on a worldwide, perpetual, and irrevocable basis. This assignment is made for full consideration included within the reward arrangement.
The brand receives exclusive ownership of all rights in the content, including the right to use, reproduce, modify, adapt, distribute, sublicense, and publicly display the content for any commercial purpose across all media channels — including social media, websites, email, print, and paid advertising — without restriction and in perpetuity.
The ambassador waives all moral rights in the content to the fullest extent permitted by the Copyright Act 1968 (Cth). Note: under Australian law, moral rights cannot be fully extinguished — ambassadors waive their right to enforce moral rights in relation to the brand's commercial use of the content as described above.
Background IP — any tools, techniques, or pre-existing materials used by the ambassador in creating the content remain owned by the ambassador, but are licensed to the brand on a royalty-free, perpetual basis to the extent necessary to use the content as described above.
Amador does not act as escrow or guarantor of content rights. Brands should satisfy themselves that content submitted by ambassadors is original, does not infringe third-party rights, and complies with any relevant releases.
5.6 Acceptable Use of Content
You must not use content obtained through Amador in any way that is pornographic, obscene, defamatory, or unlawful, or in breach of any applicable consumer protection, advertising, or privacy laws.
5.7 Subscription Plans & Fees
Brand access is available on a free tier or via paid subscription plans, billed in AUD on a monthly or annual basis via Stripe. Founding Brand pricing is locked at the rate applicable at the time of subscription for as long as the subscription remains active and uninterrupted.
5.8 Refund Policy
Due to the digital nature of our Services, we generally do not offer refunds on subscription fees. Refunds may be provided at our discretion, or where required by the Australian Consumer Law.
5.9 Non-Circumvention
Where a brand identifies or engages an ambassador through the Amador platform, all reward arrangements and direct payment offers must be facilitated through the platform for a period of 12 months from first contact.
6. Additional Terms for Ambassadors
6.1 Independent Participation
Ambassadors participate in Amador as independent individuals, not as employees, contractors, or agents of Amador.
6.2 Content Submission
By submitting content to a campaign, you represent and warrant that the content is your original work, you hold all necessary rights, the content does not infringe any third-party rights, and the content does not contain false, misleading, defamatory, or unlawful material.
6.3 Amador Points
Ambassadors may earn Amador Points by taking qualifying actions on the platform. Points are non-monetary loyalty reward credits only, cannot be transferred or exchanged for cash, do not expire while your account remains active, and can be redeemed for brand reward offers as published on the platform.
6.4 Reward Redemption
Reward offers are fulfilled by the brand, not Amador. Amador does not guarantee the quality, accuracy, or availability of any reward offer.
6.5 Direct Offers
Brands may make you a direct offer for your content. You may accept or decline any direct offer at your discretion. You are responsible for your own tax obligations as an independent contractor or individual.
6.6 Prohibited Conduct
Ambassadors must not submit content that is not their original work, fabricate or falsify reviews, create fake accounts or participate in campaigns on behalf of others, or harass, threaten, or engage in abusive conduct.
7. Content Licence to Amador
By submitting content to the platform, ambassadors grant Amador a non-exclusive, worldwide, royalty-free licence to use, reproduce, host, display, and distribute that content solely for the purposes of operating, improving, and promoting the platform. Amador will not sell ambassador content to third parties as a standalone asset.
8. Acceptable Use Policy
All users agree not to use the Services for any unlawful, harmful, fraudulent, or deceptive purpose; submit false or misleading information; impersonate any person or entity; harass or discriminate against other users; use automated tools without express written consent; introduce viruses or harmful code; or collect personal data of other users without consent.
9. Intellectual Property
All intellectual property in the platform — including its design, functionality, branding, copy, and underlying technology — is owned by or licenced to Amador Pty Ltd. You are granted a limited, non-exclusive, revocable licence to use the platform for its intended purposes only.

Amador is committed to handling personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs). Our Privacy Policy, available at amador.life/privacy, explains how we collect, use, store, and disclose your personal information. Contact hello@amador.app to exercise your privacy rights.
11. Third-Party Services
The platform integrates with third-party services including Stripe (payment processing), Supabase (data storage), Vercel (hosting), and AI providers for campaign assistance features. Amador is not responsible for any issues, outages, or failures attributable to third-party providers.
12. Warranties & Disclaimers
To the maximum extent permitted by applicable law, the Services are provided on an 'as is' and 'as available' basis without any warranty of any kind. Nothing in these Terms excludes liability that cannot be excluded under the Australian Consumer Law.
13. Limitation of Liability
To the fullest extent permitted by law, Amador's total liability to any user for any claim is limited to the greater of: the total fees paid by you to Amador in the three (3) months preceding the event giving rise to the claim, or AUD $100. Amador is not liable for any indirect, consequential, incidental, punitive, or special damages.
14. Indemnity
You agree to indemnify, defend, and hold harmless Amador Pty Ltd, its officers, employees, contractors, and agents from and against any claims, damages, liabilities, costs, or expenses arising out of or in connection with your use of the Services, content you submit, or your breach of these Terms.
15. Breach of Terms
If you breach these Terms, Amador may issue a formal warning, suspend your access, remove content you have submitted, cancel or void any Amador Points balance, refer the matter to law enforcement, or take legal action to recover losses.
16. Dispute Resolution
16.1 Between Users
Amador does not mediate disputes between brands and ambassadors. If you believe another user has acted in breach of these Terms, you may report this to hello@amador.app.
16.2 With Amador
If you have a dispute with Amador, please contact us at hello@amador.app. We will attempt to resolve the matter within 30 days. If unresolved informally, the parties agree to engage in good faith mediation before commencing any legal proceedings.
16.3 Governing Law
These Terms are governed by the laws of New South Wales, Australia. Any legal proceedings must be brought in the courts of New South Wales.
17. General Provisions
17.1 Entire Agreement
These Terms, together with the Privacy Policy, constitute the entire agreement between you and Amador relating to the Services.
17.2 Severability
If any provision is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
17.3 Waiver
Failure by Amador to enforce any provision does not constitute a waiver of that provision or any other right.
17.4 Assignment
Amador may assign or transfer its rights and obligations without your consent. You may not assign your rights without our prior written consent.
17.5 Force Majeure
Amador is not liable for any failure or delay in performance resulting from causes beyond its reasonable control.
17.6 Notices
Notices from Amador may be provided via email, in-app notification, or by posting to the platform.
